EMFSA (Electromagnetic Fields South Africa), a South African EMF advocacy organisation, has compiled the legal record on mobile phone radiation: twelve proceedings in the United States, Canada, Italy and the European Union between 2001 and 2026. Every American product-liability claim failed, first on federal pre-emption of state-law claims against phones that meet the limits set by the Federal Communications Commission (FCC), the US telecoms regulator, and most recently because the plaintiffs' causation experts were ruled inadmissible. Five Italian occupational compensation awards for tumours on nerves in the head were upheld over the same years, three on appeal. Two matters are still live.

Quotes

"The court concluded that the plaintiffs had not presented admissible expert evidence sufficient to establish general causation—that mobile phone radiation could cause the relevant types of brain tumours."

— EMFSA

"In several cases, courts accepted evidence of a causal or contributory relationship between the claimant’s exposure and the diagnosed condition under the applicable Italian legal test. These findings should not be dismissed or misrepresented."

— EMFSA

"The distinction works both ways: a court ruling does not, on its own, establish a general scientific conclusion, but neither does uncertainty in the wider scientific evidence invalidate a court’s findings in an individual case."
